Dental Insurance Regulatory Activity
During 2025, Telos tracked 25 bills in state legislatures related to dental insurance, plus two more bulletins issued by insurance departments to provide direction on the application of dental insurance regulations. The vast majority added a minimum loss ratio for dental insurance products, introduced annual experience reporting requirements, or both. Here is a quick summary of the four bills that did become law:
So far in 2026 we are tracking 16 bills related to dental insurance, plus a bulletin on implementing the ND bill noted above. All 16 of these bills introduce an annual dental loss ratio filing requirement, and most of the 16 also require a minimum loss ratio in the range of 75% - 85%. One Mississippi bill has been approved at this point that requires annual loss ratio filing. The other states where these bills are being considered in 2026: AK, AL, HI, ID, MN, MO, NE, NY, WA, WV.
Proposed regulatory activity related to dental insurance has been increasing, essentially since Massachusetts added a dental loss ratio requirement effective in 2024. Several other states have dental loss ratio reporting requirements in place now, and it appears that additional states may be adding similar requirements in the near future.
